EmergeNET LLC, dba Emerge, incorporated in the state of Michigan, with its principal place of business located at 3250 W Big Beaver Road, Suite 233, Troy, Michigan 48084 ("Emerge", "we", "us", or "our") understands that you are concerned about privacy. We have therefore posted this Privacy and Cookies Policy (this "Privacy Policy") to let you know what kind of personal information we collect, how it is handled, and with whom it may be shared.
This Privacy Policy applies to the online and offline practices regarding the processing of personal information of all users, including secondary school students, teachers, schools, post-secondary students, private companies, customers and visitors carried out by Emerge as the data controller, including on www.emergenet.com and other related websites linked to this Privacy Policy, and any software programs we utilize in our physical locations (collectively "Websites") as well as iOS and Android mobile applications ("Apps").
Processing by other affiliated entities or third parties may be governed by separate privacy policies, and we recommend that you review those policies. These Websites and Apps are intended for users in the United States, specifically within the states of Michigan and Ohio, and are not intended for users in other locations. If you are located outside of the United States, please note that by using our services, you may be transferring your personal information to a country that does not have the same data protection laws as your home country.
Information We Collect and How We Use It
Personal Information
"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to a particular consumer or household. We may also record calls made to us. The following are categories of personal information we may collect:

Personal information does not include:
- Publicly available information from government records.
- Deidentified or aggregate information — information that cannot reasonably identify a particular individual and for which Emerge has implemented technical safeguards prohibiting reidentification.
- Excluded information — health or medical information covered by HIPAA or clinical trial data, and data covered under the Fair Credit Reporting Act (FCRA).
Sources of Personal Information
- Personal information you provide — forms, service purchases, reviews, customer service interactions, social media, and career inquiries. By providing your mobile number, you agree that Emerge may send you periodic SMS or MMS messages. Text STOP to unsubscribe at any time. Message and data rates may apply.
- Automatically collected personal information — collected via cookies or other online tracking technologies when you visit and navigate our Websites.
- Personal information obtained from third parties — business partners or other third party companies. We may merge such information with what we collect directly.

Limited Sharing of Your Information
We may share your personal information only with schools who are authorized to access such information and who are involved in the job-matching process. Such sharing is governed by strict protocols. We do not share your personal information with any outside companies that perform services for us.
Joint Promotions and Offers
We sometimes offer promotions in conjunction with a third party. If you participate, we may share your information with that third party. We recommend reviewing the third party's privacy policy before participating.
Other Disclosures
We may disclose your personal information in response to subpoenas, court orders, or other lawful requests by public authorities, or to protect the rights, property, or safety of our businesses, customers, or others. We may also share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or liquidation of all or any portion of our business, assets, or stock.
Retention Period
It is our policy to retain your personal information in cloud hosting services provided by Amazon Web Services (AWS) or any other cloud computing platform for the length of time required for the specific purpose for which it was collected:

We securely erase or anonymize your personal information once it is no longer needed.
Access Control and Security
The security of your personal information is important to us. We maintain reasonable administrative, technical, and physical safeguards to secure the personal information we collect. Your personal data is protected through a combination of access control, security audits, and back-up practices. The system is backed up weekly with all backups securely stored in AWS.
All access to Emerge accounts is managed via Single-Sign-On (SSO) authentication for authorized personnel. For regular email access, Emerge utilizes a magic link authentication system which eliminates the need for passwords and ensures a secure login experience.
In the event of a data breach, Emerge will promptly notify affected users within 72 hours of becoming aware of the breach, including details about the breach, data that may have been compromised, and recommended actions.
Emerge also commits to the following regarding user data:
- Emerge collects only name and email for login.
- Emerge respects the user's choice to hide their email address (which Sign in with Apple automatically handles).
- Emerge does not track app interactions for ads without explicit opt-in consent.
Children's Privacy
It is our policy not to knowingly collect personal information from individuals under the age of thirteen and we do not knowingly distribute such information to third parties. Our platform is not directed to individuals under the age of fourteen. If you are a parent or guardian and suspect that your child may have submitted personal information to us, please contact us. If we become aware that a child has provided us with personal information, we will strive to delete such information from our files as soon as possible.
Your Privacy Rights / Users Outside the United States
Despite the fact that the Websites and Apps are intended for users in the United States (specifically Michigan and Ohio), we are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction, including the right to request correction, modification or deletion of your personal information and the right to opt out of the sale of your personal information. We will do our best to honor your requests subject to any legal and contractual obligations.
If you choose to access or use the Websites or the Apps outside the United States, you do so on your own initiative and you are solely responsible for complying with applicable local laws.

Texas Privacy Rights

As the app developer/publisher, Emerge may access aggregate analytics, user reviews, performance metrics, crash reports, beta testing feedback, and financial reports through App Store Connect.
Google Play Store
To use Android devices and access the Play Store, users typically provide a Google Account (email, password, name, date of birth), optional payment information, device information, and optional two-step verification.
As the app developer/publisher, Emerge may access aggregate user analytics, user reviews, performance metrics, crash reports, beta testing feedback, and financial reports through the Google Play Console.

EMERGE MAKES NO WARRANTY OF ANY KIND REGARDING THE WEBSITES OR THE APPS AND HEREBY EXPRESSLY DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD PARTIES RIGHTS.
The Apps may contain links to other independent third-party websites. These linked sites are provided solely as a convenience and are not under Emerge's control. Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites.
Exclusion of Damages
IN NO EVENT SHALL EMERGE BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY, FOR ANY GENERAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT, DIRECT, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO THIS PRIVACY POLICY OR USE OF THE WEBSITES OR THE APPS. BY USING THE WEBSITES OR THE APPS, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED.
Limitation of Liability
Except as otherwise required by applicable law, if Emerge is found to be liable to you for any damages or losses arising out of or connected to this Privacy Policy or your use of the Websites or the Apps, the total aggregate liability of Emerge for any and all such claims, regardless of the form of action, is limited to US$50.
Dispute Resolution
All matters relating to your access to or use of the Websites or the Apps will be governed by the laws of the United States and the state of Michigan, excluding conflicts of law principles. To the fullest extent permitted by law, all disputes shall be finally settled by binding arbitration administered by the American Arbitration Association (AAA) under the Commercial Dispute Resolution Procedures.
The location of arbitration shall be in Detroit, Michigan. To the extent any lawsuit or court proceeding is permitted, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Detroit, Michigan. Any claim under this Privacy Policy must be brought within one (1) year after the cause of action arises.
Exercising Your Privacy Rights
- No fee usually required — You will not have to pay a fee to access your personal information or exercise other rights. We may charge a reasonable fee or decline to comply if your request is clearly unfounded, repetitive, or excessive.
